The Ryan Haight Online Pharmacy Consumer Protection Act, which was signed into federal law in 2008, amended the Controlled Substances Act (CSA)to prohibit the delivery, distribution, or dispensing of controlled substances via the Internet without a valid prescription. An online pharmacy is usually considered any business entity in the United States or internationally that deliberately sells or proffers to sell controlled substances in federal schedules III-V over the Internet, or any business entity that pays a pharmacy or pharmacies a fee to fill prescriptions from practitioners referred from the Internet. Pharmacies that would like to sell controlled substances via the Internet need an appropriate modification of registration from the Drug Enforcement Agency (DEA) for all Internet business beginning April 13, 2009. The enforcement of the aforementioned CSA and Ryan Haight Act is becoming increasingly more common and the penalties enacted, more severe. The following sanctions and penalties have been levied by the United States Department of Justice against online pharmacies and/or its operator(s):
- Racketeering
- Conspiracy to commit money laundering
- Conspiracy to distribute controlled substances
- Illegal distribution of controlled substances
- Introduction of misbranded drugs into interstate commerce
- Aiding and abetting
- Criminal forfeiture
- Imprisonment from 5 years to a maximum sentence of life
